4. Purchase and Payment Terms

When purchasing an online exam, you agree to pay the fees associated with that exam. All payments are processed through third-party payment processors, and you agree to comply with their terms and conditions. We reserve the right to change our fees at any time. However, any changes will not affect the fees for exams that you have already purchased.

5. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the property of KSTQB or its content suppliers and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without the prior written consent of KSTQB.

6. License to Use the Services

Subject to your compliance with these Terms, KSTQB grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal, non-commercial use. This license does not permit you to resell any part of the Services, including online exams, or to use the Services for any unlawful purpose.

7. Termination

We may terminate or suspend your access to all or part of the Services without notice if you breach these Terms or engage in any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to us or third parties. Upon termination, your right to use the Services will immediately cease.

8. Refund Policy

All sales of online exams are final. Due to the nature of our products, we do not offer refunds beyond the booking cancellation date specified for each exam. However, if you experience any issues accessing or using the exam, please contact our customer support team at info@kstqb.org.

9. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. KSTQB makes no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, or products included on the Site. You expressly agree that your use of the Services is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, KSTQB will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, lost profits, data loss, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Services.

You agree to defend, indemnify, and hold harmless KSTQB and its affiliates, 

directors, officers, employees, agents, partners, and licensors from and against any and all claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

• Your access to or use of the Services.

• Your violation of these Terms.

• Your violation of any rights of a third party, including but not limited to intellectual property rights.

• Your violation of any applicable laws or regulations.
